  • Hotel bookings

  • UAE visa assistance
  • Travel insurance assistance
  • Medical tourism facilitation
  • Customized travel arrangements
  • Group travel
  • MICE and event-related travel services
  • Other travel-related products and services

4. WEBSITE USE

You agree to use this Website only for lawful purposes.

You must not use the Website in any way that may:

7. BOOKING PROCESS

All bookings are subject to:

  • Supplier confirmation;
  • Payment confirmation;
  • Verification of customer information;
  • Compliance with applicable laws;
  • Acceptance of supplier terms.

A booking is confirmed only when Be Happy issues a written confirmation, invoice, receipt, booking reference, ticket, voucher, or travel document.

Website prices, package details, itineraries, descriptions, availability, and offers are for guidance only until final confirmation is issued.

Be Happy reserves the right to refuse, cancel, or modify bookings before confirmation.

8. CUSTOMER RESPONSIBILITY

Customers are solely responsible for:

  • Providing accurate personal details;
  • Providing correct passenger names as per passport;
  • Providing valid passport and identification documents;
  • Checking travel dates, times, destinations, and services;
  • Ensuring passport validity;
  • Obtaining required visas, permits, approvals, vaccinations, and health documents;
  • Checking immigration, customs, health, and entry requirements;
  • Arriving on time for flights, transfers, tours, activities, hotel check-in, and appointments;
  • Reading and understanding booking confirmations;
  • Complying with local laws and supplier rules.

Any loss, cost, cancellation, rejection, delay, penalty, or denied service caused by incorrect information or failure to comply with requirements shall be the customer’s responsibility.

9. ACCURACY OF INFORMATION

Be Happy makes reasonable efforts to ensure that Website information is accurate and updated.

However, travel information may change without notice, including prices, availability, hotel policies, government regulations, visa rules, flight schedules, attraction timings, taxes, and supplier conditions.

Website content is provided for general guidance only and should not be treated as a guaranteed representation.

Be Happy reserves the right to add, alter, correct, update, or delete Website content at any time without prior notice.

We do not accept liability for errors, omissions, outdated information, technical issues, or reliance placed on Website content to the fullest extent permitted by law.

10. PRICES, CURRENCY AND EXCHANGE RATES

Unless otherwise stated, prices are displayed in United Arab Emirates Dirhams (AED).

Prices may be subject to:

  • Tourism fees;
  • Municipality fees;
  • City taxes;
  • Hotel taxes;
  • Resort fees;
  • Service charges;
  • Supplier surcharges;
  • Government fees;
  • Bank charges;
  • Payment gateway fees.

If payment is made in another currency, exchange rates may be determined by Be Happy, payment processors, banks, or card issuers.

Any exchange rate difference, foreign transaction charge, bank fee, card issuer fee, or currency conversion loss shall be the customer's responsibility.

11. PAYMENT TERMS

Payment terms will be communicated during the booking or transaction process.

Bookings may require:

  • Full payment;
  • Partial payment;
  • Deposit;
  • Advance payment;
  • Balance payment before service date.

Be Happy reserves the right to modify payment terms for specific bookings, services, customers, suppliers, or transactions at its discretion.

Failure to pay within the required time may result in cancellation of the booking without liability to Be Happy.

12. PAYMENT METHODS

Be Happy may accept payment through:

  • Credit cards;
  • Debit cards;
  • Bank transfers;
  • Online payment gateways;
  • Payment links;
  • Cash payments where permitted;
  • Other approved payment methods.

Payment is considered received only when cleared funds are credited to Be Happy’s account.

For bank transfers, customers must share proof of payment. Bank charges and transfer fees shall be paid by the customer unless otherwise agreed in writing.

13. CREDIT CARD PAYMENT RESPONSIBILITY

By using credit card or debit card payment services, the customer agrees to the following:

The customer is responsible for providing accurate and updated card information.

The customer confirms that they are legally authorized to use the card or payment method.

The customer authorizes Be Happy to charge the agreed amount for the selected services.

The customer must ensure sufficient funds or credit limit are available to complete the transaction.

Be Happy shall not be responsible for failed payments, incorrect card information, declined transactions, bank charges, card issuer fees, or consequences arising from inaccurate payment details.

14. PAYMENT SECURITY AND UNAUTHORIZED USE

Customers are responsible for maintaining the confidentiality of their account details, card details, payment information, OTPs, passwords, and booking credentials.

Be Happy shall not be liable for unauthorized use resulting from the customer’s failure to keep information secure.

If unauthorized access, unauthorized card use, suspicious transaction, or account misuse occurs, the customer must notify Be Happy immediately.

Customers agree to cooperate fully with any investigation relating to unauthorized account use, card use, payment disputes, fraud, or suspicious transactions.

Be Happy reserves the right to take legal action against users involved in fraudulent, unauthorized, deceptive, or unlawful activities.

15. TRANSACTION FEES AND LATE PAYMENTS

Certain payment methods may attract transaction fees, gateway charges, bank charges, or administrative fees.

Such fees may be communicated during the transaction process.

In case of late payment, Be Happy reserves the right to:

  • Cancel the booking;
  • Charge late payment fees;
  • Recover outstanding amounts;
  • Withhold documents, vouchers, or confirmations;
  • Take legal or collection action.

16. CHARGEBACKS AND PAYMENT DISPUTES

If a customer believes there is an error in a transaction, the customer must promptly contact Be Happy to resolve the issue.

Customers agree not to initiate chargebacks or payment disputes without first allowing Be Happy reasonable opportunity to investigate and resolve the matter.

Where services have been booked, confirmed, issued, delivered, reserved, or made non-refundable according to supplier terms, Be Happy reserves the right to contest chargebacks.

The customer may be liable for chargeback costs, bank fees, legal costs, collection charges, and administrative fees arising from unjustified or fraudulent chargebacks.

17. TAXES

Unless expressly stated, prices may exclude applicable taxes, fees, levies, tourism charges, airport charges, city taxes, hotel charges, resort fees, and government-imposed fees.

Such charges may be added to the final invoice or payable directly by the customer to the supplier, hotel, government authority, airport, or service provider.

18. CONFIDENTIALITY

Any pricing, quotations, itineraries, package details, private offers, business information, customer-specific deals, supplier rates, or unpublished information shared by Be Happy shall be treated as confidential.

Customers, users, agents, or third parties must not copy, share, disclose, misuse, or commercially exploit confidential information without written permission from Be Happy.

19. HOTEL BOOKINGS

Hotel bookings are subject to hotel availability and hotel-specific terms.

Customers must comply with hotel rules, including check-in, check-out, identification, deposits, occupancy limits, smoking rules, visitor policies, dress codes, and local laws.

Standard hotel check-in time is usually around 2:00 PM or 3:00 PM, but may vary by hotel.

Standard hotel check-out time is usually around 11:00 AM or 12:00 PM, but may vary by hotel.

Early check-in and late check-out are subject to availability and may incur additional charges.

20. HOTEL IDENTIFICATION, DEPOSITS AND EXTRA CHARGES

Hotels may require:

  • Passport;
  • Emirates ID;
  • Government-issued identification;
  • Booking confirmation;
  • Credit card pre-authorization;
  • Security deposit.

Customers are responsible for settling all hotel bills, including:

  • Room charges;
  • Mini-bar;
  • Food and beverage;
  • Laundry;
  • Damages;
  • Room upgrades;
  • Additional guests;
  • Early check-in;
  • Late check-out;
  • Tourism Dirham Fee;
  • Resort fees;
  • Local taxes;
  • Incidental expenses.

Be Happy is not responsible for hotel charges payable directly by the customer.

21. HOTEL CANCELLATION, NO-SHOW AND EARLY DEPARTURE

Hotels may impose cancellation, amendment, early departure, and no-show penalties.

A no-show may result in 100% cancellation charges.

Early departure may also result in partial or full charges depending on hotel policy.

Refunds, if any, are subject to hotel approval and hotel terms.

22. TOURS, ACTIVITIES AND ATTRACTION TICKETS

Tours, activities, excursions, attraction tickets, and experiences are subject to supplier terms and operational conditions.

Customers must arrive on time and follow all instructions.

Some activities may have age, height, weight, health, clothing, safety, or fitness restrictions.

Be Happy shall not be responsible if a customer is refused participation due to failure to meet requirements.

Unused tickets, missed tours, late arrivals, or partially used services may be non-refundable.

23. TRANSFERS AND TRANSPORTATION

Customers must provide accurate pickup location, drop-off location, flight number, arrival time, departure time, hotel details, and contact number.

Waiting time may be limited.

If the customer is not present at the designated pickup location, the service may be treated as a no-show.

Additional charges may apply for:

  • Extra waiting time;
  • Additional stops;
  • Route changes;
  • Incorrect pickup details;
  • Flight delays beyond included waiting time;
  • Oversized luggage;
  • Late-night or special transfers.

24. FLIGHTS AND AIRLINES

Where flight-related services are arranged, airlines remain responsible for their own operations.

Be Happy shall not be liable for:

  • Flight delays;
  • Flight cancellations;
  • Schedule changes;
  • Overbooking;
  • Denied boarding;
  • Baggage loss;
  • Baggage damage;
  • Airline strikes;
  • Missed connections;
  • Seat allocation;
  • Airline refund delays.

25. CRUISE BOOKINGS

Cruise bookings are subject to cruise operator terms.

Cruise itineraries, ports, timings, cabins, onboard rules, cancellation charges, and operational decisions are controlled by the cruise operator.

Changes due to weather, safety, port restrictions, or operational reasons shall not be the liability of Be Happy.

26. VISA ASSISTANCE SERVICES

Be Happy provides visa assistance and facilitation services only.

Be Happy does not issue visas and does not guarantee visa approval.

Visa approval, rejection, delay, validity, conditions, and entry permission are solely determined by embassies, consulates, immigration departments, and government authorities.

Visa fees, embassy fees, immigration fees, documentation charges, typing fees, courier fees, and service charges may be non-refundable regardless of visa outcome.

Customers must provide complete, accurate, valid, and genuine documents.

Be Happy shall not be responsible for visa rejection, delay, incorrect documents, false information, immigration refusal, or changes in visa rules.

27. PASSPORT, VISA AND ENTRY REQUIREMENTS

Customers are solely responsible for ensuring that they possess valid passports, visas, permits, vaccination certificates, travel approvals, transit permissions, and other required documents.

Many countries require passports to be valid for at least six (6) months from the travel date.

Customers must check destination, transit, airline, immigration, and health requirements before travel.

No refund shall be provided for unused services due to invalid documents, expired passports, visa issues, denied boarding, denied entry, deportation, or immigration refusal.

28. IMMIGRATION AND BORDER CONTROL

Entry into any country is at the sole discretion of immigration, customs, border control, airport, airline, security, health, and government authorities.

Visa approval does not guarantee entry.

Be Happy cannot influence or challenge immigration decisions.

Customers shall bear all costs arising from denied entry, detention, deportation, fines, penalties, rescheduling, accommodation, return travel, or missed services.

29. MEDICAL TOURISM FACILITATION

For medical tourism services, Be Happy acts only as a facilitator between customers and healthcare providers.

Be Happy does not provide medical advice, diagnosis, treatment, surgery, prescriptions, guarantees, or medical opinions.

All medical decisions, consultations, treatments, procedures, risks, outcomes, complications, and follow-ups are the sole responsibility of the healthcare provider and the customer.

Customers should seek independent medical advice before confirming any treatment.

Be Happy is not liable for medical negligence, treatment dissatisfaction, complications, misdiagnosis, failed treatment, recovery delays, additional medical expenses, or health outcomes.

30. MEDICAL DOCUMENTS AND HEALTH INFORMATION

Customers requesting medical tourism services may be required to provide medical reports, prescriptions, health records, diagnostic documents, insurance information, or treatment history.

Customers confirm that all medical information provided is accurate and voluntarily shared.

Be Happy may share such information with hospitals, clinics, doctors, or healthcare partners for the purpose of facilitating requested services.

Customers remain responsible for verifying healthcare provider qualifications, treatment plans, costs, risks, and suitability.

31. TRAVEL INSURANCE

Travel insurance is strongly recommended for all travelers.

Insurance may cover, subject to policy terms:

  • Medical emergencies;
  • Trip cancellation;
  • Baggage loss;
  • Flight delays;
  • Personal accident;
  • Emergency evacuation;
  • Other covered risks.

Insurance claims, approvals, exclusions, benefits, and payments are controlled solely by the insurer.

Be Happy is not responsible for rejected claims, exclusions, delays, or coverage disputes.

32. CANCELLATION POLICY

Cancellation terms vary by service, supplier, destination, travel date, and booking type.

Cancellation rules will be communicated during booking or stated in the confirmation.

Customers must follow cancellation deadlines to avoid penalties.

Some services may become non-refundable immediately after booking.

Be Happy reserves the right to modify cancellation terms for specific services, suppliers, or transactions where required.

33. NO-SHOW POLICY

A “No-Show” occurs when a customer fails to arrive, attend, board, check in, participate, or use a booked service without prior written cancellation.

No-show services may be charged at 100% of the booking value.

No refund shall be provided for no-show services unless expressly approved by the supplier in writing.

34. REFUND POLICY

Refunds, if applicable, shall be processed according to supplier rules and booking terms.

Refunds may be subject to deduction of:

  • Supplier cancellation charges;
  • Service fees;
  • Administrative fees;
  • Payment gateway charges;
  • Bank charges;
  • Currency conversion losses;
  • Government fees;
  • Visa fees;
  • Non-refundable components.

Refund processing time depends on suppliers, banks, card issuers, and payment processors.

Be Happy shall not be liable for delays caused by third parties.

35. MODIFICATION OF BOOKINGS

Customers may request booking modifications, but changes are subject to:

  • Fare differences;

Be Happy reserves the right to approve or deny modification requests depending on supplier terms and availability.

36. UNUSED SERVICES

No refund shall be provided for unused or partially used services, including but not limited to:

  • Missed transfers;
  • Missed tours;
  • Unused hotel nights;
  • Unused attraction tickets;
  • Missed flights;
  • Unused meals;
  • Unused package inclusions;
  • Early departure;
  • Voluntary cancellation during travel.

37. FORCE MAJEURE

Be Happy shall not be liable for delay, cancellation, interruption, non-performance, or loss caused by events beyond reasonable control, including:

  • Acts of God;
  • Natural disasters;
  • Floods;
  • Earthquakes;
  • Storms;
  • Fire;
  • Pandemics;
  • Epidemics;
  • Government restrictions;
  • Border closures;
  • War;
  • Terrorism;
  • Civil unrest;
  • Political instability;
  • Strikes;
  • Airline disruptions;
  • Supplier failure;
  • Technical failures;
  • Weather conditions;
  • Public health emergencies.

In such circumstances, refunds, credits, postponements, or alternative arrangements shall depend on supplier policies and applicable law.

38. HEALTH, FITNESS AND SPECIAL REQUIREMENTS

Customers are responsible for ensuring they are fit to travel and participate in booked services.

Any medical condition, pregnancy, disability, allergy, dietary restriction, mobility issue, or special request must be disclosed before booking.

Special requests are subject to availability and cannot be guaranteed unless confirmed in writing.

Failure to disclose relevant information may result in denied service without refund.

39. CUSTOMER CONDUCT

Customers must behave responsibly, respectfully, and lawfully.

Suppliers may refuse service or remove customers for:

  • Abusive behavior;
  • Violence;
  • Harassment;
  • Intoxication;
  • Unsafe conduct;
  • Property damage;
  • Illegal activity;
  • Non-compliance with rules;
  • Disturbing other guests.

No refund shall be due where service is refused due to customer conduct.

Customers shall be liable for damages, penalties, fines, claims, or losses caused by their actions.

40. THIRD-PARTY SUPPLIERS

Many services are provided by independent third-party suppliers.

Be Happy is not liable for acts, errors, omissions, negligence, delays, cancellations, insolvency, overbooking, operational failures, or service quality issues caused by third-party suppliers.

Supplier terms and conditions may apply in addition to these Terms.

41. WEBSITE SECURITY

Be Happy takes reasonable measures to protect Website and payment security.

However, customers are responsible for protecting their systems, devices, passwords, account information, and payment details from viruses, malware, unauthorized access, or cyber risks.

Be Happy does not guarantee that the Website will always be free from viruses, interruptions, vulnerabilities, or technical errors.

42. WEBSITE AVAILABILITY

We do not guarantee uninterrupted access to the Website.

Be Happy Travel & Tourism L.L.C may use such materials only for identification, reference, informational, promotional, booking, or service-guidance purposes.

Such use does not imply ownership, sponsorship, endorsement, partnership, or official affiliation unless expressly stated in writing.

If any rightful owner believes that their intellectual property has been used without proper authorization, they may contact us at hello@behappy.ae with supporting details.

Upon valid notification, Be Happy Travel & Tourism L.L.C will review the matter and may remove, replace, or modify the relevant material where appropriate.

To the fullest extent permitted by law, Be Happy Travel & Tourism L.L.C shall not be liable for any claim, penalty, enforcement action, loss, or damages arising from unintentional or informational use of third-party intellectual property, provided that we act reasonably upon receiving a valid notice from the rightful owner.

45. UNAUTHORIZED USE AND CONSEQUENCES

Customers confirm that they are not subject to sanctions, embargoes, trade restrictions, or legal prohibitions that prevent Be Happy from lawfully providing services.

Be Happy reserves the right to reject, cancel, suspend, or refuse bookings where required by law, regulation, sanctions, internal compliance policies, or government requirements.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the United Arab Emirates and the Emirate of Dubai.

52. DISPUTE RESOLUTION

Any dispute, claim, or controversy arising from the Website, bookings, payments, services, or these Terms shall be subject to the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates.

Customers agree to first attempt amicable resolution by contacting Be Happy before initiating legal proceedings.

Be Happy reserves the right to amend, update, replace, or modify these Terms & Conditions at any time without prior notice.

54. SEVERABILITY

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable.

55. ENTIRE AGREEMENT

These Terms & Conditions, together with the Privacy Policy, booking confirmation, invoice, supplier terms, cancellation rules, and written communications from Be Happy, constitute the entire agreement between the customer and Be Happy.

56. SURVIVAL

Clauses relating to payments, cancellations, refunds, chargebacks, limitation of liability, indemnification, intellectual property, confidentiality, privacy, dispute resolution, and governing law shall survive completion, cancellation, or termination of services.
